Lord Dundas who brought the indictment owns nearly all the land in the township, and the road leads near his mansion house and through the village. Before the Christmas Sessions, Lord Dundas viewed the road and found it in good repair, but the court at Malton refused to discharge the presentment without a certificate signed by two Justices

With certificate from two Justices confirming that they have viewed part of the road from the town of Marske to the market town of Guisborough lying in the township of Upleatham, beginning where the road branches off the road leading from Marske to the town of Skelton and ending at a bridge called Skelton Ellers Bridge, being 3,500 yards in length, and have found it to be in good repair
