TitleMotion paper relating to an appeal against the removal of Elizabeth Barker
DescriptionPaper to move at the Christmas Sessions [1833] to enter and respite an appeal made between Constable Burton (appellants) and Exelby, Leeming and Newton (respondents) against the removal of Elizabeth Barker singlewoman. Barker was born at Constable Burton and is now aged about 26 years. She went to live with her uncle Leonard Outhwaite, who lived at Arrathorne, when she was two years old, and has lived with him ever since. She moved from Arrathorne to Leeming with him, and he provided her with meat and clothes. After a time, he began to sell bread and about six years ago, he hired her, allowing her a penny as wages for every shillingsworth of bread that she sold. She continued to live with her uncle until she became pregnant. Exelby, Leeming and Newton obtained an order to remove her to Constable Burton on 26 December [1832] supposedly hoping that she would be confined there, as there would not be time for give the legal eight days' notice of an appeal, and this would make the illegitimate child belong to Constable Burton. If there is sufficient evidence to prove a hiring and service for a year, then a settlement would have been gained in Exelby, Leeming and Newton
