Johnson had been previously convicted of felony by two Justices of the Peace at the parish of Scarborough on 26 December 1861 for entering a close of land occupied by William Allison and the property of Sir John Vanden Bempde Johnstone baronet with a gun and net for the purpose of taking game, at the parish of Hackness at about 6 a.m. on 21 December. Johnson was sentenced to hard labour at the House of Correction at Northallerton for three calendar months and then had to make a recognizance for himself in £10 and two sureties in £5 each or one surety in £10 for his not offending again for one year
Johnson was also convicted by two Justices of the Peace at the parish of Norton in the East Riding on 17 January 1863 for entering enclosed land occupied by John Frankish and the property of Lord Londesborough with nets for the purpose of taking game at the parish of Willerby in the East Riding at about 3 a.m. on 12 January 1863. Johnson was sentenced to hard labour at the House of Correction at Beverley in the East Riding for six calendar months and then had to make a recognizance for himself in £20 and two sureties in £10 each or one surety in £20 for his not offending again for two years Endorsed with names of witnesses and "true bill"
