For affection towards kindred of Lady Margaret Sir Thomas Posthumus Hoby demises to Henry Marriott
Messuages, tenements and 4 oxgangs, closes and enclosures, in Everley - and common of pasture for all cattle on commonable grounds in lordship of Hackness and in Harwooddale, Silpho, Suffield, Hackness and Broxa, so long as they remain unenclosed Also power to cut turves on such part of the premises in the lordship of Hackness as shall be allocated for the same yearly, before 1 March by Sir Thomas Posthumus Hoby or the lords forthe time being
And if there is not any part of the premises specially appointed for the cutting of turves by Henry Marriott or the tenant in possession, it may be lawful for Henry Marriott etc. to cut turves sufficient for their needs for one year on the wastes of the lordship of Hackness at their liking or choice (excepting on woods, underwoods, mines and quarries)
Rent of £8 per annum Proviso of avoidance for arrears or for sub-letting other than to Henry Marriotts heirs Henry Marriott and his heirs to receive houseboot, ploughboot, cartboot and hedgeboot, and to use the same on repairs of house and premises 1 November 1638
Endorsement that Henry Marriott is intending to marry and has requested licence of Sir Thomas Posthumus Hoby that he may assure messuage and 2 oxgangs, part of the premises, for 70 years to be a jointure for his future wife 30 November 1638
